1. Introduction

Welcome to Utamaduni Nature Park & Resort ("the Park", "we", "us", "our"). By visiting our premises, making an online booking, signing a digital waiver, or accessing this website, you ("Visitor", "you") confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions in their entirety. These Terms apply to all visitors — individuals, school groups, corporate teams, and organised excursions alike.

If you do not accept these Terms, you must refrain from accessing the Park or its digital services. We reserve the right to update these Terms at any time without prior notice; continued use of the Park or website constitutes acceptance of the revised Terms.

2. Admission & Entry Requirements

  • All visitors must present a valid booking confirmation, group admission pass, or individual ticket upon entry. The Park reserves the right to verify the identity of any visitor.
  • Children under the age of 12 must be accompanied by a parent, legal guardian, or a designated responsible adult at all times throughout the Park.
  • Group leaders are responsible for the conduct and safety of all members within their party. Schools and corporate organisations are required to ensure adequate chaperone ratios.
  • The Park management reserves the absolute right to refuse entry or remove any visitor who violates Park rules, behaves in a manner deemed unsafe or disruptive, or whose presence poses a risk to fellow visitors, wildlife, or staff — without entitlement to a refund.
  • Visitors under the influence of alcohol or controlled substances will be denied entry.

3. Safety, Conduct & Park Rules

The well-being of our visitors, staff, and ecosystem is paramount. All visitors must:

  • Force Majeure: In the event of extraordinary circumstances (government directives, severe weather, public health emergencies) that force a closure, bookings will be rescheduled or credited at no penalty.
  • Stay on designated trails and paths. Venturing off marked routes is strictly prohibited and poses serious personal safety risks.
  • Do not feed, touch, approach, or provoke wildlife under any circumstances. Our animals are wild and must be observed respectfully from a safe distance.
  • Maintain environmental integrity. Littering, picking plants, removing soil, rocks, or any natural material is strictly forbidden. We ask all visitors to leave only footprints.
  • No open fires, fireworks, or smoking within the Park except in designated areas, if any.
  • Noise levels must be kept to a minimum in wildlife zones out of respect for the natural environment and other visitors.
  • Weapons, illegal substances, glass containers, and drones are prohibited without explicit prior written consent from management.
  • Pets and domestic animals are not permitted within the Park premises unless specifically arranged and authorised in advance.

4. Waivers & Assumption of Risk

Participation in outdoor and adventure activities at Utamaduni Nature Park & Resort involves inherent risks that cannot be fully eliminated, including but not limited to: uneven terrain, wildlife encounters, weather conditions, and the natural and unpredictable nature of the environment.

Prior to participating in any such activities, all visitors (or their guardians, in the case of minors) are required to read and sign our digital Indemnity Waiver. By signing, you:

  • Acknowledge the inherent risks associated with visiting a nature park environment.
  • Voluntarily assume personal responsibility for those risks.
  • Release Utamaduni Nature Park & Resort, its management, rangers, employees, and agents from any claims arising from personal injury, illness, death, or property damage.

This waiver is a prerequisite for entry into activity zones and is legally binding under the laws of the Republic of Kenya.

5. Group Bookings, Payments & Cancellations

  • Booking Confirmation: Group visit bookings are only confirmed upon receipt of a signed booking form and a 50% deposit of the applicable package fee.
  • Final Payment: The balance is due no later than 48 hours before the scheduled visit date unless otherwise agreed in writing with management.
  • Cancellations (7+ days prior): Eligible for a full refund of the deposit, or free rescheduling to an available date within 6 months.
  • Cancellations (3–6 days prior): The deposit may be converted to a credit note valid for 3 months. No cash refund will be issued.
  • Cancellations (within 48 hours): Non-refundable. Rescheduling is at the sole discretion of management and subject to availability.
  • No-Shows: Bookings for groups that do not arrive without notice will be treated as cancelled within 48 hours.
  • Force Majeure: In the event of extraordinary circumstances (government directives, severe weather, public health emergencies) that force a closure, bookings will be rescheduled or credited at no penalty.
  • Pricing is subject to change. The rate applicable at the time of booking confirmation shall apply to that booking.

6. Photography & Intellectual Property

  • Personal photography for private, non-commercial use is welcome throughout most areas of the Park. Photography in restricted zones as indicated by signage is prohibited.
  • Commercial photography, videography, or filming — including for social media monetisation, advertising, or media production — requires prior written approval and may be subject to a location fee.
  • All content on this website, including imagery, videos, logos, text, and design elements, is the intellectual property of Utamaduni Nature Park & Resort and is protected under Kenyan and international copyright law. Reproduction without express written consent is prohibited.

7. Health & Medical Considerations

Visitors with medical conditions, physical limitations, or special needs are encouraged to contact us in advance so we may make appropriate arrangements. The Park is set in a natural environment and some areas may not be fully accessible to persons with mobility challenges.

The Park does not maintain medical facilities on-site. Whilst our staff are trained in basic first aid, visitors are advised to carry any personal medication required. In a medical emergency, the nearest hospital or emergency services will be contacted immediately.

8. Liability Limitation

To the fullest extent permitted by Kenyan law, Utamaduni Nature Park & Resort, its directors, management, employees, and agents shall not be liable for:

  • Personal injury, illness, or fatality arising from natural hazards, wildlife, weather conditions, or failure to comply with Park safety rules.
  • Loss, theft, or damage to personal property, vehicles, or valuables brought onto Park premises. Visitors are solely responsible for the security of their belongings.
  • Any indirect, consequential, or incidental loss arising from the use of the Park or its digital services.

Where liability cannot be excluded by law, our liability is limited to the amount paid for the specific visit or service giving rise to the claim.

9. Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. In the event of a dispute, you agree to first attempt resolution through good-faith negotiation with the Park management. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
